associated digital services, including the Capacity Snapshot™ self-assessment tool.
We are committed to protecting your privacy and to processing your personal information in
a lawful, transparent, and purposeful manner. This Policy has been prepared in compliance
with the Protection of Personal Information Act 4 of 2013 (POPIA), South Africa's primary
data protection legislation, and takes cognisance of international standards including the
General Data Protection Regulation (GDPR) where applicable to users outside South Africa.

3.2 Assessment Data (Capacity Snapshot™)
The Capacity Snapshot™ is a structured self-assessment tool designed to help individuals
understand their current capacity across ten pillars of Adaptive Capacity. When you
complete this assessment, we collect your responses, which may include information about
your psychological state, physical wellbeing, leadership experience, and personal
circumstances as you choose to disclose them.
This category of data is processed with heightened care. Please refer to Section 7 for detail
on special categories of information.
3.3 Automatically Collected Information
When you visit our website, certain technical information is collected automatically by our
systems or third-party tools, including:
• IP address and approximate geographic location
• Browser type, version, and device type
• Pages visited, time on site, and navigation patterns
• Referral source (how you arrived at our site)
This data is collected for website analytics, security monitoring, and service improvement. It
is not used to personally identify individual visitors unless combined with other information
you have provided.

communications via email. You may unsubscribe at any time using the link in any email we

To provide access to the Capacity Snapshot™ assessment, generate your personalised
results, and deliver the insights, reports, or follow-up content associated with your
participation.

To analyse aggregated and anonymised assessment data to understand patterns in
capacity, burnout, and leadership health across our community. This informs the
development of our framework, programmes, and publications. No individual will be
identified in any research output without their explicit consent.
d) Legal and Administrative Obligations
To fulfil our legal obligations, maintain accurate records, and respond to lawful requests from
regulatory bodies where required.
5. Legal Basis for Processing
Under POPIA, we rely on the following grounds for processing your personal information:
• Consent — where you have actively opted in to receive communications or complete
the assessment
• Contractual necessity — where processing is required to deliver a service you have
requested
• Legitimate interest — for anonymised data analysis and service improvement,
balanced against your right to privacy
• Legal obligation — where we are required to process data to comply with applicable

We do not sell, rent, or trade your personal information. We share information only in the
following circumstances:
Service Providers (Operators)
We work with carefully selected third-party platforms that process data on our behalf as
Operators under POPIA. These include:
• GoHighLevel (GHL) — our CRM, automation, and assessment delivery platform
• Email delivery providers used by GHL
• Analytics tools used to understand website engagement
All operators are contractually required to process your data only on our instructions and to
maintain appropriate security standards.
We may disclose personal information where required by law, court order, or competent
regulatory authority.
Business Transfers
In the event of a merger, acquisition, or transfer of business operations, personal information
may be transferred to a successor entity, subject to equivalent privacy protections.
7. Special Categories of Personal Information
Some information collected through the Capacity Snapshot™ may relate to your health,
psychological state, or personal circumstances. Under POPIA, this is treated as a special
category of personal information and is subject to heightened protection.
We process this information solely:
• With your explicit consent, obtained at the point of assessment
• For the purpose of generating your personal capacity insights
• In anonymised and aggregated form for research and framework development
We do not use this information for diagnostic, clinical, or medical purposes. The Capacity
Snapshot™ is an educational and developmental tool and does not constitute a clinical
assessment or mental health diagnosis.
8. Data Retention
We retain your personal information for as long as necessary to fulfil the purposes for which
it was collected, or as required by applicable law:
• Email subscriber records: retained for the duration of your subscription plus 12
months following unsubscription
• Assessment data: retained for 36 months to enable longitudinal comparison and
programme development, after which it is anonymised or deleted
• Legal and financial records: retained for the period required by South African law
You may request deletion of your data at any time (see Section 10).
9. Data Security
We implement technical and organisational measures appropriate to the nature of the
information we hold, including:
• Secure encrypted data transmission (HTTPS)
• Access controls limiting data access to authorised personnel only
• Use of reputable, security-certified third-party platforms
• Regular review of our data handling practices
No method of electronic transmission or storage is completely secure. While we take all
reasonable precautions, we cannot guarantee absolute security. In the event of a data
breach that poses a risk to your rights, we will notify you and the Information Regulator as
required under POPIA.

As a data subject under POPIA, you have the following rights:
• Right of Access — to request a record of the personal information we hold about you
• Right to Correction — to request correction of inaccurate, incomplete, or outdated
information
• Right to Deletion — to request deletion of your personal information, subject to our
legal retention obligations

consent-based, without affecting the lawfulness of prior processing

appropriate steps to remove that information.

services, or legal obligations. The current version will always be available on our website

At The Capacity Lab, we do not extract. We do not exploit. Everything we gather from you
serves one purpose: to help us build something more useful, more precise, and more human
— for you and for the community you are now part of.
This Informed Consent Notice explains clearly what you are agreeing to when you join our
email community or complete the Capacity Snapshot™ self-assessment. Please read it
before proceeding. Your participation is always a choice, and it should always be an
informed one.
Part A — Joining the Community (Email List)
What you are consenting to
When you share your name and email address with us, you are consenting to receive
communications from The Capacity Lab, including:
• Curated content on capacity, burnout, leadership health, and human performance
• Insights drawn from our Adaptive Capacity framework and research
• Updates on programmes, offerings, events, and the STILL App™
• Occasional community invitations and announcements
We will not flood your inbox. We write when we have something worth saying.
What we will not do:
• We will never sell, share, or trade your email address to any third party for marketing
purposes
• We will never add you to unrelated lists without your knowledge
• We will never make your continued membership conditional on purchasing anything
How to leave:
Every email we send includes an unsubscribe link. One click is all it takes. We will process
your removal promptly and without question.
Part B — The Capacity Snapshot™ Assessment
What the Capacity Snapshot™ is
The Capacity Snapshot™ is a structured self-assessment tool developed by The Capacity
Lab as part of the Adaptive Capacity Audit™ (ACA™) suite. It is designed to help individuals
and leaders gain insight into their current capacity across ten pillars — from physical
sustainability to psychological bandwidth, relational health to financial stability.
It is an educational and developmental instrument. It is not a clinical assessment. It is not a
mental health diagnosis. It does not replace professional medical, psychological, or
therapeutic care. If you are in crisis or require clinical support, please seek qualified
professional help.
What information the Snapshot collects
The Capacity Snapshot™ collects your responses to a series of structured questions. These
responses may touch on:
• Your energy levels, sleep, and physical wellbeing
• Your psychological state, stress levels, and emotional bandwidth
• Your leadership experience, professional pressures, and workplace dynamics
• Your financial circumstances, relationship quality, and sense of meaning
You control what you share. You may choose not to answer any question that feels too
personal. Your assessment results will not be more or less valid based on how much or how
little you disclose.
How we use your Snapshot data
Your personal results
Your individual responses are used to generate your personalised capacity profile and,
where applicable, recommendations for relevant resources or programmes.
Research and community development
With your consent, your anonymised and de-identified data may be included in aggregate
research that helps us understand capacity trends, refine our framework, and develop more
effective support for our community. No individual will ever be identified in any research,
report, or publication.
Service improvement
Aggregate patterns in assessment data inform how we build, sequence, and improve our
programmes, the STILL App™, and future editions of the ACA™ suite.
What we will not do with your Snapshot data
• We will not share your individual responses with any third party without your explicit,
separate consent
• We will not use your data to make automated decisions that significantly affect you
• We will not use your data for purposes beyond those stated in this Notice or in our
Privacy Policy
• We will not retain personally identifiable assessment data beyond 36 months without
your renewed consent
Part C — Your Rights and Choices
You are always in control. At any time, you may:
• Withdraw your consent to receive emails
• Request access to the personal information we hold about you
• Request correction of any inaccurate information
• Request deletion of your data, subject to legal retention requirements
• Ask us to stop processing your data for research purposes while retaining your
subscription

Part D — How We Protect Your Information
Your data is held within our GoHighLevel (GHL) CRM environment and processed by
authorised members of The Capacity Lab team only. We apply appropriate technical and
organisational safeguards, and we hold all who access your data to strict standards of
confidentiality.
